Terms of Service

1. Scope
These Terms of Service ("Terms") govern your use of the Nodion.ai API and related services ("Service") provided by Nodion GmbH ("Nodion", "we", "us"), a company registered in Germany. By creating an account or using the Service, you agree to these Terms.
2. Service Description
Nodion provides API access to open-source large language models hosted on European GPU infrastructure. The Service includes a free tier and paid plans with usage-based billing.
3. Account Registration
You must provide a valid email address to create an account. You are responsible for maintaining the security of your API keys and account credentials. You must not share API keys with unauthorized third parties.
4. Acceptable Use
You agree not to use the Service to:
- Generate content that violates applicable law
- Attempt to circumvent rate limits or usage quotas
- Reverse engineer, probe, or test the vulnerability of the Service
- Resell or redistribute API access without prior written agreement
- Transmit malware or interfere with the Service's operation
5. Pricing and Payment
Usage is billed per token as displayed on our pricing page. Prices are in EUR and exclusive of VAT where applicable. We reserve the right to adjust pricing with 30 days' notice. Prepaid balances are non-refundable except where required by law.
6. Free Tier
The free tier provides up to 100,000 tokens per calendar month at no cost. Free tier usage is subject to rate limits. We reserve the right to modify or discontinue the free tier with 30 days' notice.
7. Availability and SLA
We aim to provide high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranty of any kind. Scheduled maintenance will be communicated in advance where possible.
8. Data Processing
All data is processed exclusively within the European Union. We do not store, log, or train on your prompts or completions beyond what is necessary for billing and abuse prevention. See our Privacy Policy for details.
9. Intellectual Property
You retain all rights to your input and output content. We claim no ownership over content generated through the Service. The models served are open-source and subject to their respective licenses.
10. Limitation of Liability
To the maximum extent permitted by law, Nodion's total liability shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
11. Termination
You may close your account at any time. We may suspend or terminate accounts that violate these Terms or engage in abusive behavior. Upon termination, your remaining balance (if any) will be handled in accordance with applicable law.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany. The courts of Stuttgart, Germany shall have exclusive jurisdiction for any disputes.
